Terms of use

The plain-language version: your art is yours, be kind, and if you buy Pro, Paddle handles the payment.

Draft. These terms are a draft pending review by a qualified lawyer and are not yet in force. Items in [brackets] are still to be completed.

Draft of 28 September 2026.

1. Agreement

These terms are an agreement between you and Epic Legend (Pty) Ltd (registration number [registration number], [physical address], South Africa; "we", "us") about your use of the Lumier Pro app and lumierpro.com. By using Lumier Pro you agree to them. Our privacy policy explains how we handle personal information.

Nothing in these terms limits rights you have under consumer-protection law that can't be excluded, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002 in South Africa, and the consumer laws of the country where you live.

2. Early access

Lumier Pro is in early access. Features may change, be added or be removed, and things may not always work as intended. Your artwork is saved on your device as you work, but please export copies of anything important and keep backups.

3. Accounts

You don't need an account to use Lumier Pro. If you create one, give accurate details, keep your sign-in secure, and tell us if you think someone else has used it. Accounts are for people aged 18 or over, or younger people with a parent's or guardian's consent. [Confirm minimum age.]

4. Using the app

We give you a personal, non-exclusive, non-transferable, revocable licence to use Lumier Pro, for personal or commercial creative work, on the devices you own or control, in line with these terms and any plan you've bought. The app, its code, design, brushes, textures and branding remain ours or our licensors'. You may not copy, sell, rent or redistribute the app, or reverse engineer it except where the law allows you to.

5. Your artwork

You own what you make. We claim no ownership of, and no licence to, the artwork and files you create or open in Lumier Pro. They're stored on your device. If you later choose to use a feature that sends files to our servers (such as sync), you give us only the limited permission needed to store, process and return them to you, and that permission ends when you delete them.

You're responsible for making sure you have the rights to the images, brushes and other material you import, and for what you do with your work.

6. Brushes and content packs

Brushes, grains, textures and other content we supply, free or premium, may be used to create your own artwork, including artwork you sell. You may not sell, share or redistribute the brushes or packs themselves, or extract them for use as stock assets. Premium packs are available while you have an active plan that includes them; artwork you've already made with them is unaffected.

7. Subscriptions and payment

Pro subscriptions are sold by our reseller and merchant of record, Paddle (Paddle.com Market Ltd and its affiliates). When you buy, your contract for payment is with Paddle and Paddle's buyer terms apply to the purchase. Paddle handles payment, invoicing, sales tax and VAT, and customer billing queries.

  • Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price until you cancel.
  • Cancelling. You can cancel at any time from your account or from the link in your Paddle receipt. Cancelling stops the next renewal; Pro remains active until the end of the period you've paid for.
  • Trials. If a plan includes a free trial, it converts to a paid subscription at the end of the trial unless you cancel before then. [Trial length, when decided.]
  • Price changes. We'll give you at least [30 days'] notice of a price change, which applies from your next renewal. If you don't agree, you can cancel before it takes effect.
  • Prices and tax. Prices are shown at checkout in the currency offered for your region and include or add tax as required where you live.

8. Refunds

Refund requests are handled by Paddle in line with Paddle's refund policy and buyer terms. Contact Paddle through the link in your receipt, or email support@lumierpro.com and we'll help. This doesn't affect any statutory right you have to cancel or get a refund, for example cooling-off rights under the Electronic Communications and Transactions Act where they apply, or your rights under the consumer law of your country. [Lawyer to confirm how ECTA s44 and EU withdrawal rights apply to digital subscriptions.]

9. Acceptable use

Don't use Lumier Pro or our services to break the law, infringe others' rights, create or distribute child sexual abuse material, harass people, attack or overload our servers, get around licence checks or share premium downloads, or interfere with other users. We may suspend accounts that do.

10. Other companies' formats and trademarks

Lumier Pro can open and save files in formats used by other applications so you can move your work freely. Adobe and Photoshop are trademarks of Adobe; Procreate is a trademark of Savage Interactive; Clip Studio Paint is a trademark of Celsys. Lumier Pro is not affiliated with, endorsed by or sponsored by these companies. When a file can't be converted exactly, the app tells you what changed.

11. Availability and changes

Lumier Pro works offline once installed, but online services (accounts, purchases, premium downloads) may occasionally be unavailable for maintenance or reasons outside our control. We may update the app and these terms. We'll give reasonable notice of material changes to the terms, in the app or by email; if you keep using Lumier Pro after they take effect, the new terms apply. If you don't agree, stop using the service and cancel any subscription.

12. Warranties and liability

We work hard to make Lumier Pro reliable, and we warrant that paid features will be provided with reasonable care and skill. To the extent the law allows, the app is otherwise provided "as is", particularly during early access, and we don't promise that it will be uninterrupted or error-free.

To the extent the law allows, we're not liable for indirect or consequential loss, or for loss of data you could have avoided by keeping backups, and our total liability to you is limited to the amount you paid for Lumier Pro in the 12 months before the claim. None of this limits liability that can't be limited by law, including for gross negligence, fraud, or death or personal injury caused by our negligence, or your rights under the Consumer Protection Act.

13. Ending these terms

You can stop using Lumier Pro at any time and delete your account by emailing us. We may suspend or end your access if you seriously or repeatedly break these terms, after warning you where reasonable. Sections that by their nature should survive (such as your ownership of your artwork, and liability) continue after these terms end. Your artwork stays on your device either way.

14. Governing law

These terms are governed by the laws of the Republic of South Africa. Disputes will be heard by the courts of [the Gauteng Division of the High Court, Johannesburg], but if you're a consumer living elsewhere you keep the protection of the mandatory laws of your country and may bring proceedings there.
